美國“頂流殺手”出庭又火了！恐怖主義指控被駁回，全場粉絲歡呼慶祝……

大家還記得他嗎？出生于富裕家庭，畢業于賓夕法尼亞大學，先后獲得工程學學士和碩士學位的路易吉·曼吉奧內（Luigi Mangione），在去年26歲的時候，用一把3D技術打印的手槍，當街射殺聯合健康保險公司CEO布萊恩·湯普森（Brian Thompson）。

在美國，醫療保險體系飽受爭議：保費昂貴、理賠困難、藥價高企。很多普通民眾對大保險公司極度不滿，認為它們“剝削病人、只顧盈利”。

而路易吉出生優渥，卻選擇和底層人民站在一起，反抗壓迫，被美國網友稱為“全民英雄”、“當代蝙蝠俠”。再加上他帥氣的外形，落網被捕時，都能把橙色囚服，穿出愛馬仕最新款的超絕時尚表現力，更是為他吸引了大批狂熱追隨者。

路易吉的入獄，牽動了很多人的心。終于在這個9月，路易吉又公開露面了，他身穿褐色囚服，戴著手銬和腳鐐，被押送至紐約曼哈頓州法院出席庭審。

褐色囚服在他身上，完全沒有沉悶感，反而被穿出了低調的高級感。現場的外國攝影師們早已按捺不住，一個比一個拼命按快門，就怕錯過能秒殺同行的那一張路透。

言歸正傳，這次的庭審對于路易吉意義重大。法官駁回了紐約州對他的恐怖主義指控，但維持謀殺罪名。

Justice Gregory Carro ruled that prosecutors had not presented enough evidence to the grand jury that Mangione acted with the intent to intimidate health insurance workers or influence government policy, which would have been necessary to prove murder as an act ofterrorism.

法官格雷戈里·卡羅裁定，檢方未能向大陪審團提供足夠證據，證明曼吉奧內是出于恐嚇醫療保險從業者，或影響政府政策的目的而作案。而這是將謀殺行為定性為恐怖主義所必需的條件。

The judge set Mangione's next court date in the case for December 1.Mangione could still facelife in prisonif convicted of murder in the second degree, which is defined as an intentional killing.

法官將曼吉奧內的下一次庭審日期定在 12 月 1 日。如果二級謀殺罪（即有預謀的故意殺人罪）成立，曼吉奧內仍可能面臨終身監禁。

The U.S. Justice Department is seeking thedeath penaltyin the federal case against Mangione. Carro's dismissal of the state-level terrorism counts has no bearing on the federal case.

美國司法部在聯邦案件中正尋求對曼吉奧內判處死刑。而卡羅法官對州一級涉恐指控的駁回，并不會影響聯邦案件的審理。

美國是聯邦制國家，州法和聯邦法是兩套獨立的法律體系：

1. 州法主要管轄本州范圍內的普通刑事案件（如謀殺、搶劫）。

2. 聯邦法適用于跨州、涉及國家利益、恐怖主義、金融欺詐、毒品走私等案件。

所以，一個行為既可能違反州法，也可能違反聯邦法。州法院和聯邦法院是獨立審理的。所以雖然州法官駁回了涉恐罪名，但這不影響聯邦政府繼續追究死刑。

Echoing the scene at his last hearing, a few dozen supporters — mostly women — packed three rows in the rear of the courtroom gallery. Some were dressed in green, the color worn by the Mario Bros. video game character Luigi.

與上一次出庭時的場景類似，幾十名支持者——大多是女性——擠滿了法庭后方的三排座位。有人身穿綠色衣服，呼應馬里奧兄弟游戲中路易吉的標志性顏色。

One woman sported a “FREE LUIGI” T-shirt. Across the street from the courthouse, cheers erupted from a pro-Mangione rally as news spread that the judge had dismissed his terrorism charges.

Outside the Manhattan Supreme Court on Tuesday a handful of Mangione's supporters gathered, some of them holding placards with slogans such as "Free Luigi" and "Innocent until proven guilty".

Mangione has attracted highly visible crowds of advocates to his court appearances as well as supporters online, who have fundraised hundreds of thousands of dollars for his defense against murder and other charges for the assassination-style shooting.

曼吉奧內的出庭持續吸引著大批公開支持者，線上也有不少人為他聲援，甚至已為他籌集了數十萬美元，用于應對謀殺等指控以及這起“暗殺式槍擊”案件的辯護。
