Beijing Arbitration Commission Launches New Arbitration Rules: Dual-Engine Drive for International and Domestic Arbitration

北京仲裁委員會/北京國際仲裁院/中國（北京）證券期貨仲裁中心（以下稱“北仲”）于2025年10月29日召開第八屆委員會第十六次會議，審議并通過了《國內仲裁規則》與《國際仲裁規則》（以下稱“新版規則”），標志著北仲“1+1+N”規則體系（一部國內規則+一部國際規則+多部特別規則）爭議解決框架正式確立。新版規則將于2026年1月1日起正式施行。現正式發布新版規則全文。

新版規則的誕生，是一場凝聚了各方智慧的“集體創作”。修訂工作自2025年1月啟動，始終秉持“科學、開放、務實”的原則，以“專業化”與“國際化”為核心。通過全球公開征集、專題研討、專家訪談、線上問卷等多元渠道，我們收獲了來自境內外仲裁員、律師、學者、企業法務及廣大用戶的寶貴建議。

Beijing Arbitration Commission/Beijing International Arbitration Court/China(Beijing)Securities and Futures Arbitration Center(hereinafter referred to as"BAC")convened the 16th meeting of the 8th committee on October 29,2025,and deliberated and adopted the Domestic Arbitration Rules and the International Arbitration Rules(hereinafter referred to as the"new rules"),marking the formal establishment of BAC's"1+1+N"rule system(one domestic rule+one international rule+multiple special rules)dispute resolution framework.The new rules will come into effect officially on January 1,2026.The full text of the new rules is now formally released.

The birth of the new rules is a"collective creation"that has pooled the wisdom of all parties.The revision work was launched in January 2025 and has always adhered to the principles of"science,openness,and pragmatism,"with"professionalism"and"internationalization"at its core.Through diverse channels such as global public solicitation,thematic seminars,expert interviews,and online questionnaires,we have received valuable suggestions from arbitrators,lawyers,scholars,corporate legal counsels,and a wide range of users both within and outside the country.

全國首例：SCIAHK“港資港仲裁”案件裁決獲認可與執行

First Case Nationwide: SCIAHK's "Hong Kong Capital, Hong Kong Arbitration" Case Ruling Recognized and Enforced

近日，華南（香港）國際仲裁院（英文簡稱SCIAHK）受理并辦結的“港資港仲裁”案件獲得深圳市中級人民法院認可與執行。該案為擔保合同糾紛，案件當事人分別為在深圳前海設立的港資企業以及內地自然人，雙方當事人一致約定本案的仲裁地為香港，開庭地點為深圳，案件審理實體法適用中華人民共和國法律，案件程序管理適用《深圳國際仲裁院仲裁規則》，本案的仲裁員來自深圳國際仲裁院與華南（香港）國際仲裁院“雙城兩院”仲裁員名冊。裁決作出后，因被申請人未在規定期限內履行相關義務，申請人向深圳市中級人民法院申請認可與執行該案裁決。

深圳市中級人民法院審查后認為，申請人系在深圳市注冊成立的香港投資企業，可協議約定香港或澳門為仲裁地。華南(香港)國際仲裁院作為約定的仲裁機構對案涉糾紛具有管轄權，且該仲裁裁決亦不存在可裁定不予認可和執行的其他情形，遂作出裁定認可和執行該仲裁裁決。

此案標志著“港資港仲裁”從仲裁協議效力認定到裁決認可執行的全流程的落地，為大灣區“一國兩制三法域”下構建共商共建共享的爭議解決機制提供了示范。

Recently,the South China International Arbitration Center(Hong Kong)(referred to as SCIAHK for short)handled and concluded a"Hong Kong capital,Hong Kong arbitration"case,which was recognized and enforced by the Shenzhen Intermediate People's Court.The case involved a guarantee contract dispute,with the parties being a Hong Kong-funded enterprise established in Qianhai,Shenzhen,and a mainland Chinese individual.Both parties unanimously agreed that the arbitration venue would be Hong Kong,the hearing location would be Shenzhen,the substantive law applicable to the case would be the laws of the People's Republic of China,and the procedural management of the case would be governed by the Arbitration Rules of the Shenzhen International Arbitration Court.The arbitrators in this case were drawn from the rosters of both the Shenzhen International Arbitration Court and the South China International Arbitration Center(Hong Kong),representing a"two cities,two courts"arrangement.After the ruling was made,since the respondent failed to fulfill the relevant obligations within the prescribed period,the applicant applied to the Shenzhen Intermediate People's Court for recognition and enforcement of the ruling.

Upon review,the Shenzhen Intermediate People's Court determined that the applicant,being a Hong Kong-invested enterprise registered in Shenzhen,was entitled to agree on Hong Kong or Macau as the arbitration venue.The South China International Arbitration Center(Hong Kong),as the agreed arbitration institution,had jurisdiction over the dispute in question,and the arbitration ruling did not present any circumstances that would warrant a refusal to recognize and enforce it.Consequently,the court ruled to recognize and enforce the arbitration ruling.

武漢仲裁委發布《建設工程施工合同糾紛裁決指引》，破解“同案不同裁”

The Wuhan Arbitration Commission has released the "Guidelines for Adjudicating Construction Engineering Contract Disputes" to address the issue of inconsistent rulings in similar cases.

10月21日，武漢仲裁委員會發布《建設工程施工合同糾紛裁決指引（試行）》，武漢成為繼上海之后全國第二個發布施工合同糾紛裁決指引的城市。該指引的發布，對于規范審理建設工程施工合同糾紛仲裁案件、妥善解決相關爭議具有重要意義。

據悉，武漢仲裁委員會此次發布的《建設工程施工合同糾紛裁決指引（試行）》涵蓋內容廣，可操作性強。指引共計一百二十七條，包括法律適用、仲裁當事人、施工合同效力、工程工期、工程計量計價、款項支付、工程質量、建設工程價款優先受償權、工程總承包合同、附則等十個章節，基本覆蓋了施工合同仲裁糾紛常見的各類爭議點。指引充分總結了武仲多年來審理建工合同糾紛的成功經驗，結合裁決實踐，針對不同類型的爭議規定相應裁判規則，規定較為具體詳細，供仲裁庭直接參照適用，也可供建工企業、案件代理人等在法律實務中借鑒。

On October 21,the Wuhan Arbitration Commission released the"Guidelines for Adjudicating Construction Engineering Contract Disputes(Trial),"making Wuhan the second city in China to issue such guidelines after Shanghai.The release of these guidelines is of great significance for standardizing the adjudication of arbitration cases involving construction engineering contract disputes and properly resolving related controversies.

It is reported that the"Guidelines for Adjudicating Construction Engineering Contract Disputes(Trial)"released by the Wuhan Arbitration Commission cover a wide range of content and are highly operational.The guidelines consist of 127 articles,including ten chapters on the application of law,arbitration parties,validity of construction contracts,project duration,measurement and pricing of projects,payment of funds,quality of projects,priority of construction project payment claims,general contracting contracts for construction projects,and supplementary provisions.These guidelines essentially cover all common types of disputes in construction contract arbitration.They fully summarize the successful experiences of the Wuhan Arbitration Commission in adjudicating construction contract disputes over the years.Combined with practical adjudication,the guidelines stipulate specific and detailed rules for different types of disputes for direct reference and application by arbitration tribunals.They can also be used as a reference by construction enterprises and case agents in legal practice.

國際調解院正式成立

The International Mediation Institute (IMI) was officially established.

2025年10月20日，國際調解院開業儀式在香港舉行。30余個國際調解院公約締約國和簽署國以及香港特區各界近200名代表出席儀式。外交部副部長華春瑩出席。

華表示，短短5個月內，國際調解院實現了公約簽署、生效和開業運營，速度之快在國際組織建設史上十分罕見，充分表明國際調解院順應時代潮流，受到國際社會的廣泛支持。國際調解院理念與全球治理倡議高度契合，奉行和解合作和諧，堅持公平公正公道，秉持共商共建共享，倡導以人為本，注重務實導向，將為構建人類命運共同體注入法治正能量，也將助力香港打造“調解之都”。歡迎更多國家積極加入，充分利用國際調解院為和平解決國際爭端作出新貢獻。

On October 20,2025,the opening ceremony of the International Mediation Institute was held in Hong Kong.More than 200 representatives from over 30 contracting and signatory countries of the International Mediation Institute Convention and from all walks of life in the Hong Kong Special Administrative Region attended the ceremony.Vice Minister of Foreign Affairs Hua Chunying was present.

Hua said that in just five months,the International Mediation Institute had realized the signing,entry into force and commencement of operations of the Convention,a speed that is very rare in the history of international organization building.This fully shows that the International Mediation Institute is in line with the trend of the times and has received wide support from the international community.The concept of the International Mediation Institute is highly consistent with the Global Governance Initiative.It advocates reconciliation,cooperation and harmony,adheres to fairness,justice and reasonableness,upholds consultation,joint construction and shared benefits,promotes a people-centered approach and focuses on pragmatism.It will inject positive energy of the rule of law into the building of a community with a shared future for mankind and will also help Hong Kong to build itself into a"mediation hub".More countries are welcome to actively join the Institute and make new contributions to the peaceful settlement of international disputes by fully utilizing it.

The International Centre for Settlement of Investment Disputes(ICSID)has released its 2025 Annual Report,offering a comprehensive overview of the Centre’s activities during fiscal year 2025(FY2025),which covered the period from July 1,2024 to June 30,2025.

For the first time,the Annual Report presents statistics regarding the application of the 2022 ICSID Rules and Regulations.These include provisions aimed at enhancing transparency and ensuring procedural fairness,such as disclosures of third-party funding(TPF)and decisions on security for costs.The 2025 Annual Report also publishes data on damages claimed and awarded in arbitration cases decided by tribunals at ICSID,as well as on the geographic origin of investors in new cases.

The Annual Report presents a detailed report on ICSID’s caseload trends,showing strong demand for ICSID’s services in FY2025.It records the highest number of registered proceedings during a single fiscal year(109,including new cases and post-award remedies),the highest number of administered cases in a fiscal year(347),and the second highest number of concluded cases in a fiscal year(81).

A Chinese-owned mining company says it will seek international arbitration after the Rwanda-backed rebel group M23 looted 70 million worth of gold from its mines in the Democratic Republic of Congo.

The mine is in South Kivu province in the east of the country,where the Rwanda-backed militants staged a lightning offensive earlier this year,seizing swathes of territory.Describing itself as a Chinese-owned Congo-based company,it told news agency Reuters that the current value of the looted gold was around$70 million.It claimed the rebels,assisted by mine employees,smuggled out the first 50 kilogrammes of gold shortly after their takeover in May.

An estimated 100 kilogrammes per month has been lost since then,it said,together with about$5 million worth of equipment and materials.Twangiza said a drone strike last Wednesday destroyed the site’s power infrastructure,though it remains unclear who was behind the attack.It has declared force majeure and plans to file formal complaints with both the Congolese authorities and international arbitration bodies.

It also accused the rebels of expelling residents,demolishing churches,and employing Rwandan technicians to extract geological data for expanded mining operations.

Eastern Congo sits atop some of the world’s most coveted mineral deposits,which has fuelled decades of fighting between rival militant groups and the Congolese army.
